Israel drops charges against soldiers accused of sexually assaulting detainee
Rights groups condemn decision as impunity after detainee abuse allegations and leaked video from Israel’s notorious Sde Teiman prison
TEL AVIV, Israel (MNTV) — Israel’s military has dropped criminal charges against five soldiers accused of violently assaulting and sexually abusing a Palestinian detainee, a move that has triggered fierce criticism from human rights organizations and deepened concerns about accountability during the Gaza war.
The soldiers had been indicted over a 2024 incident at the controversial Sde Teiman military detention facility, where prosecutors alleged the detainee was beaten, dragged across the floor, electrocuted with a taser, and sexually assaulted.
Medical reports indicated the prisoner suffered fractured ribs and a perforated rectum that required emergency surgery before he was returned to detention.
Despite the severity of the allegations, military legal authorities announced that the case would be dismissed, citing insufficient evidence for a criminal conviction and procedural issues surrounding the leak of a surveillance video that partially captured the assault.
The decision closes one of the most divisive legal cases in Israel since the outbreak of the Gaza genocide, where debate over the treatment of Palestinian detainees has sharply split public opinion.
Prime Minister Benjamin Netanyahu, himself wanted by the International Court of Justice, welcomed the ruling, defending the soldiers and saying the country should focus on fighting its enemies rather than prosecuting its troops.
Human rights groups reacted with outrage, arguing that the decision effectively signals impunity for abuse committed against Palestinians in Israeli custody.
Sari Bashi, executive director of the Public Committee Against Torture in Israel, said the ruling sends a dangerous message that serious violations against Palestinian detainees will not be punished.
She described the dismissal of the case as part of a broader pattern in which alleged abuses inside Israel’s wartime detention system are dismissed or minimized.
The case first gained widespread attention in 2024 after Israeli media aired leaked footage showing masked soldiers pulling a handcuffed Palestinian detainee away from others lying face-down in a fenced holding area inside the prison.
The soldiers were seen surrounding the detainee behind a wall of shields in a secluded corner of the enclosure before the alleged assault took place.
The Sde Teiman detention site was established after the October 7, 2023 to hold Palestinians captured during Israel’s genocide in Gaza.
Former detainees, whistleblowers and Israeli rights organizations have repeatedly described the facility as a secretive prison where beatings, humiliation and torture were commonplace.
Human rights groups say the dismissal of the charges further reinforces longstanding accusations that Israeli authorities rarely hold soldiers accountable for crimes against Palestinians.
Israel’s military maintains that its forces operate under domestic and international law and says it investigates any allegations of misconduct.
Critics, however, argue that the outcome of this case highlights a persistent culture of impunity within Israel’s wartime detention system.
